What are the overtime laws in Nevada?

It is crucial for employers to understand how overtime laws apply in Nevada. Not only do they need to pay their employees appropriately, but being proactive about this can help avoid employment disputes. Wage and hour disputes often arise when employees believe they are not being compensated correctly for their time.

One important thing to consider is how much money the employee earns as their base rate. The minimum wage in Nevada has been set at $12 per hour. Most employers are obligated to follow this instead of the federal standard of $7.25 per hour.

Why does the wage matter?

The wage helps determine when someone is eligible for overtime pay, which must be paid at time and a half their standard rate.

If someone earns less than $18 per hour—or one and a half times the minimum wage—they are eligible for overtime whenever they work more than 40 hours in a single week or more than eight hours in a 24-hour period. An employee who works 10 hours on Monday may be eligible for overtime pay for two of those hours, even though they have not yet exceeded 40 hours for the week.

For those who earn more than $18 per hour, however, there is no overtime provision for working more than eight hours in a day. Instead, they are only eligible for time and a half if they work more than 40 hours in a week.
