Playground Concussions: Who’s to blame?

Playground concussions are increasing. This is the finding of a new government study which established that injuries were mostly sustained when children were on monkey bars and swings. While most of the injuries turn out to be mild, the concussions were potentially serious which has raised flags with public health officials.
The study was done by the federal-run Centers for Disease Control and Prevention. They examined national data collected between 2001 and 2013 on playground injuries sustained by children aged 14 years and younger who had needed treatment in the emergency room. They found out that out of about 215,000 children who had been treated every year, almost 10 percent or about 21,000 each year had sustained traumatic brain injuries, concussions included. This number has been rising steadily, reaching an average of almost 30,000 kids by 2013.
The increased number of cases has made parents more wary about concussions. This is especially because repeated injuries to the head have been connected to brain damage. To this end, more and more parents are seeking legal counsel about injuries that their children have suffered on the playground.
Although personal injuries laws differ from state to state, there is the common requirement of proving liability. The plaintiff has to prove that the injury suffered by the child was sustained because a playground was unsafe. The negligence could be in the form of monkey bars that were greasy which made them slippery or a lack of a sandbox or landing mats that were thick enough to provide adequate protection.
